How to Clear Overdraft Debt: The Core Options

Clearing overdraft debt is possible — but the right path depends on how large the balance is, whether the account is still active, and whether other debts are involved. For a small, recent overdraft, a structured repayment plan with the bank may be enough. For a larger or long-standing balance, a formal debt solution may be worth exploring through a regulated specialist.

This page sets out how overdraft debt works, how interest is calculated under current FCA rules, and what formal and informal options are available to someone who cannot clear the balance on their own.

How Overdraft Debt Works Under Current FCA Rules

Since 6 April 2020, banks in England, Scotland and Wales have been required by the Financial Conduct Authority (FCA) to charge overdrafts using a single annual interest rate. Fixed daily or monthly fees are no longer permitted. According to GOV.UK and FCA guidance, this change was introduced to make overdraft costs clearer and more comparable across providers.

In practice, many major high-street banks set their arranged overdraft rate at 39.9% EAR (Effective Annual Rate). That is broadly in line with some credit cards, and significantly higher than most personal loans. An unarranged overdraft — going beyond an agreed limit, or using an overdraft on an account where none was formally arranged — typically triggers immediate refusal of payments or an emergency buffer, depending on the bank's policy.

FCA OVERDRAFT RULE (IN FORCE SINCE 6 APRIL 2020)Banks must charge one simple annual interest rate on overdrafts. Fixed daily fees and monthly charges are banned. This applies to all personal current accounts in the UK.

Because interest compounds on a daily basis, a balance that is not actively reduced will grow. Someone who remains at or near their overdraft limit each month — using income to clear spending but never reducing the core overdraft — may find the balance stays static or increases over time. This is sometimes called being "trapped" in an overdraft.

Assessing the Size of the Problem

Before choosing a strategy to clear overdraft debt, it helps to understand exactly what is owed and to whom. Overdraft debt sits with the bank that holds the current account. However, the bank may have already passed an overdue overdraft balance to a debt collection agency if the account has been closed or suspended. In that case, the debt is still the same amount but the contact will come from the collector rather than the bank directly.

A person should check whether the account is still open, whether any default notice has been issued, and whether a County Court Judgment (CCJ) has been registered. A CCJ stays on the Register of Judgments, Orders and Fines for six years unless paid in full within one calendar month of the judgment date, according to GOV.UK. If a CCJ has already been issued for an overdraft debt, the available options may be more limited and time-sensitive.

Checking Whether the Debt Is Still Legally Recoverable

Under the Limitation Act 1980, a debt in England and Wales generally becomes statute-barred after six years if the creditor has not taken court action and the debtor has made no payment or written acknowledgement during that period. In Scotland, the equivalent period under the Prescription and Limitation (Scotland) Act 1973 is five years. If an overdraft has been dormant for close to or beyond these periods, whether it is still enforceable is a question for a regulated debt adviser to assess — not something to assume either way.

Practical Routes to Clearing an Overdraft

Negotiating a Repayment Plan Directly with the Bank

Most banks are required by FCA rules to treat customers in financial difficulty fairly. That means a customer who contacts their bank proactively and explains they cannot service the overdraft may be offered a temporary interest freeze, a structured repayment schedule, or a referral to a specialist internal team. This will not always be offered automatically — it usually requires the account holder to make contact.

A repayment plan agreed directly with the bank does not affect a person's credit file in the same way a formal insolvency solution does, but the overdraft balance itself will already be marked on the credit file if payments are missed. Getting something in writing — including the interest position and agreed monthly amounts — is important.

Moving the Balance to a Lower-Rate Product

Where credit is still available, some people clear an overdraft by using a 0% money transfer credit card or a low-rate personal loan to pay off the overdraft balance. This does not reduce the amount owed, but it may reduce the interest cost — especially given that overdraft rates of 39.9% EAR are among the highest available on mainstream products. Eligibility for these products depends on the applicant's credit profile at the point of application.

This approach is only viable if the new product's credit limit covers the overdraft balance and if the individual can commit to clearing the new balance before any promotional rate expires. If the balance is simply moved and then not repaid, the problem is deferred rather than solved.

Budgeting to Reduce the Balance Over Time

For a manageable overdraft — typically under a few hundred pounds — a structured monthly budget may be enough to reduce the balance incrementally. The principle is to ensure income lands in the account before the month's spending begins, and to reduce the overdraft limit gradually as the balance falls, preventing the account drifting back into the red. Some banks will agree to reduce the limit in stages at the customer's request.

BREATHING SPACE — 60-DAY PROTECTIONThe Breathing Space (Debt Respite Scheme) in England and Wales gives eligible individuals 60 days of legal protection from creditor action, including from banks chasing overdraft debt. It is applied for through a regulated debt adviser, not directly with the creditor.

When Overdraft Debt Is Part of a Wider Debt Problem

An overdraft is an unsecured debt, which means it sits alongside credit card balances, personal loans, buy-now-pay-later balances, and similar obligations when a formal debt solution is being considered. Someone with multiple debts who cannot realistically clear their overdraft on its own may find that addressing all unsecured debt together — through a formal route — is more practical than treating each debt separately.

Debt Management Plan (DMP)

A Debt Management Plan is an informal arrangement, usually set up through a debt advice charity or a regulated firm, in which a person makes one monthly payment that is distributed to creditors including, potentially, their bank. Interest and charges may be frozen during the plan, though this depends on each creditor's agreement. A DMP does not have a fixed legal framework — creditors are not obliged to accept it — but many do.

Individual Voluntary Arrangement (IVA)

An IVA is a formal insolvency solution available in England, Wales and Northern Ireland. It involves a legally binding agreement with creditors to repay a portion of what is owed over a fixed period, typically five to six years, with the remainder written off at the end. Overdraft debt would be included as an unsecured liability. An IVA must be set up by a licensed Insolvency Practitioner.

Debt Relief Order (DRO)

A Debt Relief Order may be available to someone in England or Wales with total qualifying debt of £50,000 or less, limited assets, and a low surplus income. As of 6 April 2024, the application fee for a DRO was abolished, meaning there is now no charge to apply. A DRO lasts 12 months, during which creditors cannot take action. At the end of the moratorium period, qualifying debts — including overdrafts — are written off. According to GOV.UK, the DRO is administered through an authorised intermediary.

Bankruptcy

Bankruptcy is a formal insolvency process for those in England and Wales who cannot repay their debts. Applying costs £680 in total. Unsecured debts, including overdraft balances, are dealt with as part of the bankruptcy process. Bankruptcy has significant consequences for credit files and certain professions, and eligibility and suitability are matters for a regulated insolvency specialist to assess.

DRO DEBT LIMIT (CURRENT)The qualifying debt limit for a Debt Relief Order in England and Wales is £50,000 — raised from £30,000 on 28 June 2024. There is no application fee. Overdraft debt counts as a qualifying unsecured debt.

Common Questions About Clearing Overdraft Debt

Can a bank take someone to court over an overdraft?

Yes. An overdraft is a legally recoverable debt. If a bank or debt collector who has purchased the debt takes court action, a County Court Judgment may be issued. A CCJ remains on the public register for six years unless paid in full within one calendar month of the judgment date, according to GOV.UK.

Does an overdraft affect a credit file?

Yes. An overdraft that is used heavily, close to its limit, or where repayments are missed will be visible on a credit file. Lenders use this information in their own affordability and credit risk assessments. A persistent overdraft — one used for more than three consecutive months — may be flagged by the bank under FCA persistent debt rules, although these rules are primarily associated with credit cards rather than overdrafts.

What happens if someone ignores an overdraft balance?

If left unaddressed, an overdraft balance will continue to accrue interest. The bank may suspend the account, issue a default notice, and sell the debt to a collection agency. The agency may then pursue the balance through letters, phone calls, or ultimately court action. Ignoring the balance does not make it go away and may result in a CCJ being issued without the debtor being aware if their address is out of date.

Is overdraft debt treated differently in Scotland?

The FCA rules on overdraft interest rates apply across the whole UK. However, formal debt solutions in Scotland operate under separate legislation. The Debt Arrangement Scheme (DAS), protected trust deeds, and sequestration (bankruptcy) are the main formal routes in Scotland, and eligibility thresholds differ from those in England and Wales. A debt adviser familiar with Scots law should be consulted for Scottish cases.
